These Terms and Conditions (“Terms”) govern your access to and use of www.shonniesdesigns.com  and your purchase of clothing, home décor, gifts, and related products from SHONNIE’S DESIGNS (“we,” “us,” or “our”).

By accessing our website, creating an account, or placing an order, you agree to these Terms and our:

• Shipping Policy;

• Return and Refund Policy;

• Accessibility Statement; and

• Any additional terms displayed during checkout or on a product page.

If you do not agree to these Terms, please do not use our website.

1. Eligibility

You must be at least the age of legal majority in your state or country—or have permission from a parent or legal guardian—to make a purchase through our website.

By placing an order, you represent that:

• The information you provide is accurate and complete;

• You are authorized to use the selected payment method; and

• Your purchase and use of our products will comply with applicable law.

Our products are intended for lawful personal or gift use unless we agree otherwise in writing.

2. Customer Accounts

You may be able to create an account to save addresses, review orders, or access other features.

You are responsible for:

• Maintaining the confidentiality of your login credentials;

3. Product Information

We make reasonable efforts to display product descriptions, photographs, colors, sizes, materials, dimensions, prices, care instructions, and availability accurately.

However:

• Colors may appear differently depending on lighting, photography, and screen settings;

• Clothing measurements may vary slightly because of manufacturing methods;

• Handmade, natural, printed, or personalized products may have minor variations;

• Wood grain, stone, fabric patterns, finishes, and other natural characteristics may vary;

• Product packaging may change; and

• Measurements and weights may be approximate.

Minor variations that do not materially affect the product’s intended use are not necessarily defects.

Please read product descriptions, dimensions, warnings, care instructions, and size guides before ordering.

4. Product Availability

Products and services are subject to availability. Placing an item in your shopping cart does not reserve it.

We may:

• Limit product quantities;

• Discontinue products;

• Correct inventory errors;

• Restrict sales by location;

• Refuse orders that appear intended for unauthorized resale; or

• Cancel an order when a product is unavailable.

If we cancel an order after payment, we will refund the canceled amount to the original payment method.

5. Orders

An order is an offer to purchase the products listed in the order. An automated confirmation acknowledges that we received the order but does not necessarily mean that we accepted it.

We may review, accept, reject, or cancel an order for legitimate reasons, including:

• Product unavailability;

• Pricing or description errors;

• Suspected fraud or unauthorized payment;

• Shipping restrictions;

• Excessive order quantities;

• Violation of these Terms; or

• Inability to verify necessary information.

If we reject or cancel a paid order, we will issue the appropriate refund.

6. Pricing and Payment

Prices are displayed in US CURRENCY unless otherwise stated. Prices may change without notice, but changes will not ordinarily affect orders already accepted.

The final checkout total may include:

• Product prices;

• Sales or similar taxes;

• Shipping and handling charges;

• Gift-wrapping or personalization charges;

• Customs or import charges, when collected by us; and

• Other fees disclosed before purchase.

You authorize us and our payment providers to charge the payment method submitted during checkout for the total displayed.

We do not guarantee that every pricing or typographical error will be honored. If we discover a material pricing error, we may contact you for instructions or cancel and refund the affected order.

7. Taxes

Applicable taxes will be calculated during checkout when we are required to collect them.

International customers may be responsible for customs duties, import taxes, brokerage charges, or similar fees that are not included in the checkout total. Please review our Shipping Policy for additional information.

8. Promotions and Discount Codes

Promotions and discount codes:

• Must be used before their expiration date;

• May be subject to product or order exclusions;

• Cannot ordinarily be combined unless stated otherwise;

• Have no cash value;

• Cannot be applied retroactively; and

• May be limited to one use per customer or household.

We may modify or end a promotion as permitted by law. We may cancel discounts obtained through fraud, technical errors, unauthorized distribution, or misuse.

9. Gift Cards and Store Credit

Gift cards and store credits may be used only for eligible purchases from SHONNIE’S DESIGNS. They are not redeemable for cash except where required by law.

Gift cards must not be used for unauthorized resale or unlawful purposes. Lost or stolen gift cards may not be replaceable without acceptable proof of purchase.

Additional expiration, inactivity, or use terms will comply with applicable law and will be disclosed when the gift card or credit is issued.

10. Personalized and Custom Products

Customers ordering personalized, monogrammed, engraved, printed, or custom-made products are responsible for reviewing all submitted names, dates, wording, images, colors, sizes, and other specifications.

We may reproduce personalization exactly as submitted, including capitalization and spelling. We are not responsible for customer-submitted errors approved during checkout or through a proof.

By submitting text, photographs, artwork, logos, or other materials for personalization, you represent that:

• You own or have permission to use the material;

• Our use of it will not infringe another person’s rights; and

• The material is lawful and does not contain harmful or prohibited content.

We may refuse personalization requests containing unlawful, infringing, hateful, threatening, obscene, or otherwise inappropriate content.

Personalized and made-to-order products may be nonreturnable and noncancelable once production begins, except when defective, incorrectly produced, or otherwise required by law.

11. Shipping and Delivery

Shipping destinations, charges, processing estimates, delivery estimates, tracking, international duties, delayed shipments, and lost or damaged packages are addressed in our Shipping Policy.

Delivery dates are estimates unless expressly guaranteed. Delays may occur because of weather, carrier disruptions, customs processing, holidays, inventory issues, or events outside our reasonable control.

You are responsible for providing an accurate and complete delivery address. Contact us immediately if an address correction is required. We cannot guarantee changes after processing or shipment begins.

If we cannot ship within the promised period, we will provide any notice, cancellation option, or refund required by applicable law.

12. Returns, Exchanges, and Refunds

Return eligibility, deadlines, exclusions, shipping expenses, inspections, exchanges, damaged products, and refund processing are governed by our Return and Refund Policy.

Certain products—including personalized, made-to-order, hygiene-related, clearance, final-sale, or used products—may not be returnable except when required by law.

Nothing in these Terms limits consumer rights that cannot legally be waived.

13. Product Care and Safety

You are responsible for following all product labels, care instructions, assembly instructions, warnings, age recommendations, and safety notices.

Clothing, decorative objects, candles, glassware, ceramics, wall hangings, products containing small parts, and similar merchandise must be used appropriately and kept away from children, pets, flames, heat, or other hazards when instructed.

Home décor products are intended for decorative use unless expressly described for another purpose.

Stop using a product if it appears damaged or unsafe and contact us with any concerns.

14. Intellectual Property

Our website and its contents—including our business name, logos, graphics, product photographs, artwork, designs, text, videos, icons, website layout, and original product descriptions—are owned by or licensed to us and are protected by applicable intellectual-property laws.

Except as allowed by law or with our prior written permission, you may not:

• Copy, reproduce, republish, or distribute our content;

• Use our designs or photographs on products for sale;

• Modify or create derivative works from our content;

• Remove copyright, trademark, or ownership notices;

• Scrape or systematically download website content; or

• Use our trademarks, branding, or content in a misleading manner.

You may use the website for personal, noncommercial shopping purposes.

15. Customer Reviews and Other Content

You may be able to submit reviews, photographs, comments, testimonials, or other content.

You retain any ownership rights you have in your original content. By submitting content to us, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and share it for operating, improving, and promoting our business, subject to applicable law.

You represent that submitted content:

• Reflects your honest experience or opinion;

• Is accurate to the best of your knowledge;

• Does not infringe intellectual-property, privacy, or other rights;

• Does not contain unlawful, threatening, defamatory, obscene, or malicious material;

• Does not contain malware, spam, or unauthorized advertising; and

• Discloses any material connection, incentive, discount, or compensation when required.

We may moderate or remove content for legitimate reasons, such as irrelevance, unlawful material, private information, threats, spam, infringement, or violation of these Terms. We will not prohibit or penalize honest reviews merely because they are negative.

16. Prohibited Uses

You may not use our website to:

• Commit fraud or impersonate another person;

• Infringe intellectual-property or privacy rights;

• Upload malware or harmful code;

• Interfere with website security or operation;

By using our website, you acknowledge that information may be processed by service providers needed to operate the store, complete payments, fulfill orders, prevent fraud, and provide customer support.

19. Website Availability

We try to keep our website accurate, secure, and available, but we do not guarantee uninterrupted or error-free operation.

We may update, suspend, restrict, or discontinue website features for maintenance, security, operational, or legal reasons.

We are not responsible for temporary interruptions caused by maintenance, hosting failures, internet outages, cyberattacks, or events outside our reasonable control.

20. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis without warranties not expressly stated by us.

We do not warrant that:

• The website will always be uninterrupted, secure, or error-free;

• Every product will meet subjective expectations;

• Product photographs will display identically on every device; or

• Website errors will always be corrected immediately.

This disclaimer does not exclude any express product warranty or consumer protection that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by law, Shonnie’s Designs and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products.

Where liability cannot be excluded, our total liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires a different remedy.

These limitations do not apply to liability that cannot legally be limited, including liability that applicable law imposes for fraud, willful misconduct, personal injury, or defective products.

22. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable expenses resulting from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or unauthorized materials submitted for personalization.

This provision does not require you to indemnify us for our own unlawful conduct or negligence where such a limitation is prohibited.

23. Governing Law

These Terms are governed by the laws of New York, United States, without regard to conflict-of-law principles.

Any dispute that is not resolved informally will be brought in the courts located in New York, United States, unless applicable consumer law gives you the right to bring a claim elsewhere.

24. Informal Dispute Resolution

Before filing a legal claim, you and Shonnie’s Designs agree to make a reasonable, good-faith effort to resolve the dispute informally.

We will make a reasonable effort to respond within [30] days.

This section does not prevent either party from seeking urgent injunctive relief or using a small-claims process when legally available.

25. Termination

We may suspend or terminate access to the website when a user materially violates these Terms, engages in fraud or abuse, threatens website security, or creates legal risk.

Provisions that should reasonably continue—such as payment obligations, intellectual-property protections, disclaimers, and dispute terms—will survive termination.

26. Changes to These Terms

We may update these Terms to reflect changes in our products, business practices, technology, or legal obligations.

Revised Terms will be posted with a new “Last updated” date. When required by law, we will provide additional notice or obtain consent.

Changes generally apply prospectively and do not alter an already accepted order unless permitted by law.

27. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. The affected provision will be limited or modified only to the extent necessary to make it enforceable where permitted by law.

28. No Waiver

A delay or failure to enforce a provision of these Terms does not waive the right to enforce it later.

29. Entire Agreement

These Terms and the policies incorporated by reference constitute the complete agreement between you and us regarding use of the website and purchases made through it, except for additional written terms expressly accepted by both parties.
